November In Focus: Upcoming Changes to GDPR

This month we are highlighting changes around GDPR and the new Data (Use and Access) Act 2025 ("DUAA", "the Act") which received Royal Assent on 19 June 2025.

Under the current framework, individuals who believe their personal data has been mishandled should complain to the Information Commissioner's Office (ICO). However, this new DUA Act will require data subjects to raise their complaint firstly with the data controller of the organisation handling their data, before being able to escalate to the ICO. Therefore organisations will be legally required to have a formal complaints process for handling data protection concerns.
